LEGISLATION: Driver Safety and Law
As of August 1st, 2008, text-messaging, emailing or accessing the Web on a wireless device while driving in Minnesota (including while stopped in traffic) is illegal. The violation can cost up to $300 and applies to drivers of all ages. This is a primary offense law, which means you can be pulled over if you are observed violating the new law. See Minnesota Department of Public Safety Press Release.
More states now say cell phones and driving don't mix and more and more cell phone use and texting bans are cropping up. See USA Today article dated June 25, 2008.
While legislation is a good start - is it really enough? While most legislation bans cell phone use, texting or web access while driving - it requires the officer to actually see the motorist violating the law. Many violators will go unnoticed and will continue to endanger themselves and others.
Not only are these laws hard to enforce, a recent study shows teens in particular are ignoring them. See Fox News article dated June 9, 2008, "Study Shows Teens Ignore Safe Driving, Cell Phone Laws."
